Night shift work in Poland: how to assess an offer
The legal definition of night time, the allowance formula and three interview questions before you sign a shift-system contract.
Updated:
Night shift work changes above all your daily rhythm, not the number of hours worked. Before accepting an offer, check four things: the monthly schedule, how far in advance you receive it, how the night allowance is calculated, and transport after a night shift.
What counts as night time by law
The Polish Labour Code defines night time as 8 hours falling between 21:00 and 7:00 (Article 151(7) §1 of the Labour Code (Kodeks pracy)). The specific hours within that range, for example 22:00-6:00 or 23:00-7:00, are set by the employer's work regulations, or, when no such regulations apply, by the employment contract.
An employee is considered a night worker if their work schedule includes at least 3 hours of night work in each 24-hour period, or if at least 1/4 of their working time in the settlement period falls within night time (Article 151(7) §2 of the Labour Code). This distinction matters in practice: only once it is met do additional restrictions on night work apply to the employer. Labour Code rules on working time apply to an employment contract, while under a contract of mandate the working hours follow from the contract.
How much is the night work allowance
Under an employment contract, for each hour of night work, an employee is entitled to an allowance of 20% of the hourly rate derived from the minimum wage (Article 151(8) §1 of the Labour Code). The amount in zloty changes every month, because it depends on the number of working hours in that month. Under a contract of mandate (umowa zlecenie), a night allowance is due only if the contract provides for it. The full calculation mechanism, including differences between months, is described in the article on the night work allowance.
A night worker under the law (at least 3 hours of night work in each 24-hour period, or at least 1/4 of working time in the settlement period) who performs work that is particularly hazardous or involves significant physical or mental effort may not work more than 8 hours per day. This restriction does not apply to, among others, people managing the workplace on behalf of the employer. Under a contract of mandate, the number of hours follows from the contract.
What the system names actually mean
- Two shifts: morning and afternoon, usually on weekdays. Predictable rhythm, weekends usually free.
- Three shifts: a night shift is added, but the plant stops on weekends.
- Continuous operation: work runs all week, including Sundays and holidays, in a four-team rotation.
Continuous operation gives the most hours covered by the night allowance and the fewest free weekends.
Three questions to ask in the job interview
- What does the monthly schedule look like, not the weekly one: the rotation often only becomes clear over a longer period.
- How far in advance is the schedule given. Ask how many days ahead you receive the schedule, because that determines whether you can plan commuting, a language course or a doctor's visit.
- How are the allowances calculated for night work and work on days off under this type of contract. The guide how to read an employment contract explains what the pay clauses mean.
Night shift work: what actually helps
A steady sleep rhythm even on days off, a darkened bedroom, the last meal a few hours before sleep, and limiting caffeine in the second half of the shift: these are simple but proven solutions. The worst strategy is sleeping "in advance" and fully reversing your rhythm every weekend, because returning to night shifts after a reversed weekend starts from zero.
If you live with others, set quiet-hours rules before you start night shifts, not after the first sleepless day.
Commute after a night shift
Before accepting an offer, check how you will get home after a night shift, because the last bus, tram or train connection can run earlier than the end of the shift. For some offers we give the commuting details in the job description.
Shift work and the rest of life
Shift work complicates everything tied to fixed hours: a language course, a doctor's visit, picking up a child from school. Some things can be moved to the morning hours after a night shift, some cannot, and it is better to know this before signing the contract than after a month of work. Current listings are in job offers, and we confirm the terms of a specific offer before the contract is signed.
Frequently asked questions
How long is night time and which hours count?
Night time lasts 8 hours between 21:00 and 7:00. The exact range within these limits, e.g. 22:00-6:00, is set by the given workplace's work regulations or by the contract.
Who is considered a night worker?
A person whose work schedule includes at least 3 hours of night work in each 24-hour period, or whose working time includes at least 1/4 falling within night time in the settlement period (Article 151(7) §2 of the Labour Code).
Who is covered by the restrictions on night work?
A night worker under the law who performs work that is particularly hazardous or requires significant physical or mental effort: for them, daily working time may not exceed 8 hours. Exceptions include, among others, people managing the workplace on behalf of the employer. Under a contract of mandate, the number of hours follows from the contract.
How many days off are due after night shifts?
The law does not set a single number of days off after a night shift; this is decided by the schedule and the working time system adopted at the given workplace, so it is worth asking about it directly in the interview.
This text describes the general rules. What you are entitled to depends on your type of contract: an employment contract (umowa o pracę) or a contract of mandate (umowa zlecenie). Your own contract and payslip are what count.
