Privacy policy

Information on the processing of personal data under Articles 13 and 14 GDPR - Regulation (EU) 2016/679.

1. Controller

2. What data, why and for how long

• Candidate application (name, date of birth, gender, citizenship, contact details, address, information about a visa or residence card, education, experience, languages, driving licence, CV) - for recruitment and job placement. Basis: Article 6(1)(b) GDPR (steps prior to a contract), (c) (obligations of an employment agency and rules on entrusting work to foreign nationals) and (a) (consent to take part in future recruitment). Kept for 12 months from the application or until consent is withdrawn; if you are hired, for the period required by law.
• Employer enquiry (name, company, contact details, content of the enquiry) - to reply and perform the contract. Basis: Article 6(1)(b) and (f) GDPR. Kept for the duration of the cooperation and the limitation period for claims.
• Technical data (IP address, request time, browser) - in server logs, for the security of the website. Basis: Article 6(1)(f) GDPR. Kept for up to 12 months.
• Visit statistics (a random identifier from a cookie, pages visited, traffic source, device and browser type, approximate location, whether a form was sent) - only with consent, in Google Analytics 4, to understand how visitors use the website. Basis: Article 6(1)(a) GDPR. Kept for 14 months or until you withdraw consent with the “Cookie settings” button in the page footer.
• Accounting and tax records are kept for 5 years as required by law (Article 6(1)(c) GDPR).

Providing data is voluntary, but the fields marked with an asterisk are necessary for us to handle your application or answer your enquiry. We do not ask for the PESEL number, identity document numbers or special categories of data (Article 9 GDPR) - please do not include them in your CV.

3. Recipients

Employers and clients where a candidate may take up work (they then become separate controllers); processors acting on our instructions under a data processing agreement - hosting and e-mail providers, the visit statistics provider (Google Ireland Limited), HR software providers, our accounting office, our law firm and IT support; and bodies authorised by law, including voivodeship offices, the Powiatowy Urząd Pracy (district labour office), ZUS, tax authorities, the Państwowa Inspekcja Pracy (labour inspectorate) and the Straż Graniczna (border guard). We do not sell personal data.

4. Transfers outside the EEA

The website uses Google Fonts, Google Analytics (only with your consent), and displays a Google Maps map on the Contact and About us pages. Google then receives your IP address and browser information. Transfers to the United States take place under the European Commission adequacy decision (EU-U.S. Data Privacy Framework). If you contact us through a messenger, your data also goes to its provider - so please do not send scans of identity documents that way.

5. Your rights

You have the right to access your data and obtain a copy, to rectification, erasure, restriction of processing, data portability, and to object to processing based on our legitimate interest. You may withdraw consent at any time, without affecting the lawfulness of earlier processing. Requests: office@amer-work.com - we reply within one month. You may also lodge a complaint with Prezes Urzędu Ochrony Danych Osobowych (President of the Personal Data Protection Office), ul. Stawki 2, 00-193 Warszawa, uodo.gov.pl.

6. Other information

We take no decisions based solely on automated processing and we do not profile candidates. We use encrypted connections (TLS), access control and individual authorisations to process data. Our services are addressed to adults. Information stored on your device is described in the Cookie policy. A new version of this policy is published on the website together with the date of the update.
