Legalizing stay and legalizing work in Poland are two separate procedures: a different office issues the document, a different deadline has to be tracked, and one permit does not replace the other. You can hold a valid residence card without the right to work, and the other way around.

Legalizing stay vs. legalizing work: two tracks, two offices

Stay is legalized by: a visa, visa-free travel, a temporary or permanent residence permit, or specific statutory grounds. These cases are handled by the voivodeship office (urząd wojewódzki) or a consulate. The full course of this track is described in the article on legalizing a foreigner's stay in Poland.

Work is legalized by: a work permit, a declaration of entrusting work to a foreigner, a seasonal work permit, or an exemption that follows directly from the regulations (for example, for graduates of Polish schools and universities). Since 1 June 2025, applications for these documents are filed exclusively online through praca.gov.pl, under the act of 20 March 2025 on the conditions for permitting foreigners to be entrusted with work. The basic variant is described in the article on type A work permit.

The deadlines on both tracks run independently of each other. A valid residence card does not extend a work permit, and a valid work permit does not extend the right to stay.

Four combinations of stay and work

  • legal stay, legal work: the target state, both documents current,
  • legal stay, illegal work: the person is staying in Poland lawfully but has no basis to work,
  • illegal stay, formally valid work basis: the work permit is valid, but the residence title has expired,
  • both illegal: the situation with the heaviest consequences.

A concrete example of the second combination: a foreigner staying in Poland on a Schengen visa issued by another Schengen country for tourism, medical or educational purposes has legal stay, but during that time may not legally work in Poland.

When one permit is enough for both

Some residence titles grant the right to work on their own. This is an exception that must be confirmed in the specific case, not assumed in advance. A documented example is graduates of Polish schools and universities, who are exempt from the requirement to hold a work permit. The single permit works the same way, combining both tracks in one document; its rules are described in the article on the single permit for stay and work.

What changed in the work procedures

Since 1 June 2025, the labor market test has been abolished: the starosta's confirmation that no candidates from Poland were available for a given position, which used to be a separate extra step before filing a work permit application. The stay procedure was not covered by this change: a temporary residence application still requires its own full set of documents and a separate queue at the voivodeship office. Before filing an application it is worth checking the current status on praca.gov.pl.

What this means for an employer

Verification at hiring covers two documents, not one, and repeats every time the employment is meant to continue. The rules for continuing work after a permit expires are worth checking before that date at the office or on praca.gov.pl. A passport with a valid visa or an entry stamp alone does not answer the question of the right to work: the stay basis and the employment basis must be checked separately, and both dates kept in one place.

Frequently asked questions

Does a valid residence card automatically give the right to work?

No. A residence card confirms legal stay, and the right to work requires a separate document: a work permit, a declaration of entrusting work, or a seasonal work permit, unless the person is exempt from that requirement.

Does a Schengen visa issued by another country allow legal work in Poland?

No, if its purpose is tourism, medical treatment or education. Such a visa gives the right to legal stay in Poland, but does not give the right to work, and the possibility of taking up work on the basis of that visa is confirmed by the office before hiring.

Who is responsible if an employee has legal stay but illegal work?

The obligation to check both grounds, stay and work, lies with the party entrusting the work. Illegal work can also have consequences for the foreigner, including for their further stay in Poland, and the details of a specific case are confirmed by the voivodeship office.

Does permanent residence always exempt from the requirement to hold a work permit?

A permanent residence permit is one of the grounds that exempt from the separate work permit requirement. The appearance of the residence document alone does not confirm this: the scope of work rights follows from the type of residence title, and the office confirms it individually.

The rules on residence and employment of foreign nationals change often, and much depends on citizenship, the basis of stay and the situation of the particular person. This text describes the general course of the procedure. Before filing documents, confirm the current state of affairs at the voivodeship office.
