Legalizing a Foreigner's Stay in Poland in 2026
Grounds for stay, applying for temporary residence through the MOS portal, and mistakes that extend the case by months.
Updated:
Legalizing a foreigner's stay in Poland means holding a valid ground for stay and, before it expires, filing for the next one, most often a temporary residence permit. Such applications are now filed electronically through the MOS portal, and the voivodeship office confirms the current rules. A legal stay does not by itself mean the right to work.
What are the grounds for legal stay in Poland?
The most common grounds are:
- visa-free travel and a Schengen visa (type C): a maximum of 90 days total within a 180-day period, counted for the whole Schengen area, not for Poland alone,
- national visa (type D): the purpose stated on the sticker decides whether the visa allows work,
- temporary residence permit: issued by the voivode, confirmed by a residence card,
- permanent residence permit or EU long-term resident permit,
- temporary protection for Ukrainian citizens: the voivodeship office confirms its current deadline.
Overstaying the permitted period, even by one day, makes the stay illegal. It then risks a decision on the obligation to return, which may come with a ban on re-entering Poland and the Schengen area.
Does a legal stay give the right to work?
Not always. Example: a person holding a Schengen visa issued by another country for tourism, medical treatment, or education stays in Poland legally but may not work. We cover this difference in the article on the difference between legalizing stay and legalizing work.
| Ground for stay | Access to the labor market |
|---|---|
| Tourist visa from another Schengen country | None |
| Temporary residence and work permit | With the employer and on the terms of the voivode's decision |
| Permanent residence, EU long-term resident | With any employer, no work permit needed |
| Temporary protection (Ukrainian citizens) | Work after notification via praca.gov.pl |
The "access to the labor market" note on the card does not settle the matter by itself: the content of the voivode's decision decides. Details are in the article on the temporary residence card and work.
How to file a temporary residence application step by step?
- Check the deadline. The application must be filed by the last day of the current legal stay at the latest.
- Prepare the documents. You need documents confirming the purpose of stay (for work: the contract and documents from the employer) and a current biometric photo in electronic form: 35×45 mm, color, face forward, taken no earlier than 6 months before filing. We collected the full list in the article on documents for a residence card application.
- File the application through the MOS portal (Case Handling Module). Paper filing has generally ended. On paper, under the previous rules, only selected cases remain: intra-corporate transfer (ICT), family reunification for people staying abroad, and cases of family members of UK citizens.
- Download the certificate of filing the application. Once the application is verified and accepted, the system makes it available to print. It replaces the former passport stamp and, like the stamp, confirms during a check that the stay is legal while the proceedings are ongoing.
- Respond to office requests within the set deadline.
- After a positive decision, collect the residence card.
The stay remains legal from the day the application is filed until the day the decision becomes final, provided the application was filed during a legal stay and without formal gaps, or the gaps were filled on time.
What extends the case by months?
The most common cause is not the office itself but gaps in the application. The office calls for them to be filled within at least 14 days, and an application not completed is left without consideration. Typical mistakes:
- filing the application after the previous ground for stay has expired, which removes the legal-stay protection during the proceedings,
- a photo older than 6 months or in the wrong format,
- missing a document confirming the purpose of stay, e.g. the employer's contract,
- missing a request for information, after which the deadline for completing it passes without a response.
What does the employer do when legalizing an employee's stay?
The employer provides documents confirming employment and working conditions, and before work starts must ask the foreigner for a valid residence document. The employer keeps a copy for the whole employment period and for 2 years after the end of the year in which the employment ended.
Frequently asked questions
Is a passport stamp still needed?
No. For applications filed through MOS, the stamp has been replaced by an electronic certificate of filing the application. Entries and exits are also recorded electronically by the EES system, which replaces stamps in passports.
How long does it take to process a temporary residence application?
It depends on the voivodeship office's workload and on whether the application was complete. Every request for missing documents extends the case. During this time, the stay remains legal if the application was filed on time.
Can you file the application after the visa expires?
The application must be filed by the last day of the current legal stay at the latest. An application filed later does not protect the legality of the stay, and an overstay risks a return obligation and an entry ban.
Does a Ukrainian citizen have to file for temporary residence?
People with temporary protection stay legally without such an application, as long as the protection is in force. The voivodeship office confirms its current deadline. The UKR status is lost, however, among other reasons, after leaving Poland for more than 30 days.
The rules on residence and employment of foreign nationals change often, and much depends on citizenship, the basis of stay and the situation of the particular person. This text describes the general course of the procedure. Before filing documents, confirm the current state of affairs at the voivodeship office.
