National visa D and work are two separate matters: the visa is permission to enter and stay, not to be employed. Whether you can legally work on a D visa depends on the purpose code entered on the sticker and a separate basis for work, meaning a permit or a declaration.

What does the purpose code on national visa D mean?

On the visa sticker, both for national visa D and Schengen visa C, there is a field with the purpose-of-issue number. This number tells the authorities why you entered, and it determines whether you may work under that visa. A valid work permit will not help if the visa has a tourist purpose.

Codes linked to work:

CodeWhat it allowsTypical basis for work
05awork under a declarationdeclaration of entrusting work performance
05bwork up to 9 months in a calendar yearseasonal work permit
06other workusually a work permit

Among others, tourist visas (code 01) and transit visas do not entitle you to work, and the consulate confirms the meaning of other codes. Check the code before departure, at the consulate, not during the first inspection at the workplace.

Is a national visa D issued for work purposes enough to be employed?

No. A visa with code 05a, 05b or 06 only confirms that entry took place for work purposes. The actual right to work comes from a document issued for a specific employer:

  • a declaration of entrusting work performance (only for citizens of the countries listed in the regulations; the district labor office gives the current list), and work may only start after the declaration has been entered into the register by the district labor office (powiatowy urząd pracy);
  • a seasonal work permit (type S), limited to 9 months in a calendar year;
  • a work permit, most often type A, issued by the voivode (wojewoda).

The typical order looks like this:

  1. The employer submits an application for a permit or a declaration through praca.gov.pl.
  2. The foreigner applies at the consulate for a D visa with the correct purpose code, using that document.
  3. After entry, the person takes up work under the terms of the permit or the registered declaration.

The full list of documents needed to start is gathered in the article on documents for a first job in Poland. When a permit is not needed at all is described in the article on who is exempt from a work permit.

Schengen visa C versus national visa D

Visa C is for short stays: 90 days within a 180-day period, counted jointly across the whole Schengen area. With a visa C issued by Poland, work also requires a declaration or a permit, and a tourist visa (code 01) does not allow work. A Schengen visa issued by another country for tourism, medical treatment or education does not allow you to work in Poland, even though the stay is legal.

Exceeding the limit by even one day makes the stay illegal. This can result in a decision on the obligation to return, and in some cases also a ban on re-entering the Schengen area. The rule for counting days is explained in the article on visa-free travel and legal work.

Two changes from 2026: EES at the border and MOS for applications

These are two different changes that are easy to mix up:

  • From 10 April 2026, the EES system operates. Entries and exits of foreigners from outside the EU/EEA are recorded electronically with biometric data, and the Border Guard no longer stamps passports. No entry stamp does not mean no registration.
  • From 27 April 2026, residence applications are submitted through the MOS portal. After the application is accepted, you download an electronic confirmation of submission. It replaces the former voivode's stamp in the passport, and the voivodeship office confirms the current rules for showing it during an inspection.

What to do once the visa period runs out?

When the period of stay entered on visa D ends, continued stay requires a temporary residence permit. You submit the application through the MOS portal at the latest on the last day of legal stay. A complete application submitted on time makes the stay legal from the day of submission until the day the decision becomes final.

If there are formal shortcomings, the authority calls for them to be completed within a period of at least 14 days. An application that is not completed is left without consideration. The differences between residence pathways are laid out in the article on legalizing a foreigner's stay in Poland.

Frequently asked questions

How long is national visa D valid?

The period of validity and the number of days of stay are entered on the visa sticker as two separate values. The visa can be valid for longer than the permitted stay under it, so you check both fields.

Will I get a passport stamp at the border after 10 April 2026?

No. From that date, entries and exits are recorded electronically by the EES system, with no stamp in the travel document.

Does changing employer require a new visa?

The visa is not tied to an employer, so it remains valid when you change companies. The new employer, however, as a rule needs a new permit or a new declaration, and the authority confirms any exceptions. Details are described in the article on changing employer and the work permit.

Can I start working on a tourist visa once the employer has obtained a permit?

No. A visa with code 01 does not entitle you to work, even with a valid permit. You need a visa with a work-related purpose code or another basis for stay that allows work.

The rules on residence and employment of foreign nationals change often, and much depends on citizenship, the basis of stay and the situation of the particular person. This text describes the general course of the procedure. Before filing documents, confirm the current state of affairs at the voivodeship office.
