Residence card documents: a complete set the first time
Formal gaps in a residence card application don't end in refusal, but they add weeks to the process.
Updated:
Applying for a temporary residence permit (residence card) requires a form, a photograph, copies of passport pages, and documents on your address and health insurance, with work, employer documents are added.
What documents make up a residence card application
Regardless of the purpose of stay, the same core set repeats:
- a completed application form, signed in every required place,
- a current biometric photo in electronic format: 35x45 mm, color, face forward, taken no earlier than 6 months before filing,
- a valid passport along with copies of the pages bearing entries,
- documents confirming your place of residence in Poland,
- documents confirming health insurance.
The set is extended by documents tied to the purpose of stay. For work, employer documents are added, the exact scope is set by the voivode (voivodeship office, urząd wojewódzki) responsible for the place of stay. For family reunification: civil status certificates with translations. For studies: a certificate from the university. The full procedure is covered in the article on legalizing a foreigner's stay in Poland.
How the application is filed today
An application for a temporary residence permit is filed electronically through the MOS portal (Moduł Obsługi Spraw, case handling module). After the application is verified and accepted in the system, you get an electronic certificate of filing to download and print; it has replaced the former stamp in the passport and confirms that the case is in progress. On paper, only a limited number of categories of cases specified in the regulations are still accepted. The current list is provided by the voivodeship office.
What happens with formal gaps
When an application has formal gaps, the office calls for them to be fixed within at least 14 days. Failing to fix the gaps within that deadline results in the application being left without consideration: the case ends without a decision, and the procedure must start over. This is the main reason a complete set of documents the first time saves time: the call for corrections stops the case's clock for at least the period set for fixing the gaps, meaning no less than 14 days.
Document translations
Documents drawn up in foreign languages are filed together with a sworn translation into Polish. This is the item that most often extends preparation time, because translations are ordered separately from a sworn translator and have their own turnaround. Start by ordering translations before assembling the rest of the application, not at the end.
Make a copy of the whole set before filing and keep the certificate of filing. If you're called to fix gaps, you'll know exactly what has already been submitted, and in cases lasting many months that isn't obvious.
Why the filing date matters
An application filed during a legal stay, without formal gaps (or with gaps fixed within the set deadline), gives the right to remain in Poland from the day the application is filed until the day the decision on the case becomes final. An application filed after the previous residence title has expired does not have this effect. This distinction matters more than document completeness alone; that's why the filing deadline is tracked separately from the document checklist. The effects on work during this period are covered in the article on temporary residence card and work.
After filing the application
Report any change of your delivery address to the office. A letter sent to an address whose change was not reported may be considered delivered, and the deadlines for further steps, including any appeal, start running from the date of delivery.
Frequently asked questions
Can a residence card application still be filed on paper today?
As a rule, no. Applications for temporary residence are filed electronically through the MOS portal, and on paper only in a limited number of categories of cases specified in the regulations. Whether your case is among them will be confirmed by the voivodeship office.
What proves legal stay while the application is being processed?
The electronic certificate of filing downloaded from the MOS portal. It has replaced the former stamp in the passport and confirms that the case is in progress. The right to stay for the duration of the proceedings, however, is granted only to an application filed during a legal stay, without gaps or with gaps fixed within the deadline.
How much time is there to fix formal gaps?
The office sets the deadline in the call, no shorter than 14 days. If the gaps are not fixed within that deadline, the application is left without consideration and the procedure must start over.
Do document translations need to be ordered separately?
Yes, documents in foreign languages are filed with a sworn translation into Polish, and a sworn translator completes them on their own schedule, so it's worth ordering them as the first step.
What does filing the application during a legal stay give you?
The right to remain in Poland from the day the application is filed until the day the decision becomes final, provided the application has no gaps, or gaps were fixed within the deadline.
The rules on residence and employment of foreign nationals change often, and much depends on citizenship, the basis of stay and the situation of the particular person. This text describes the general course of the procedure. Before filing documents, confirm the current state of affairs at the voivodeship office.
