Youth PIT relief covers foreigners on the same terms as Poles: the PIT exemption for people under 26 applies to income from employment contracts and contracts of mandate, up to PLN 85,528 per year, and the payer applies it automatically from the first payment.

Does youth PIT relief apply to foreigners

Yes, citizenship makes no difference at all. What matters is age (up to the 26th birthday) and contract type. The relief covers income from employment contracts and contracts of mandate. It does not cover contracts for specific work (umowa o dzieło) or business activity. The legal basis is Article 21(1)(148) of the PIT Act.

Up to what amount does the exemption apply

In 2026 the limit is PLN 85,528 of income per year. Up to that amount, the employer or principal does not withhold a personal income tax advance. Once the limit is exceeded, an advance on general terms is calculated on the surplus, which is why, at higher earnings, the pay toward year-end can be lower than at the start, despite the same rate.

Does a declaration need to be filed

No, and this is the most commonly confused part of the relief. The payer has a statutory obligation to apply the exemption automatically, from the first payment, without any application from the employee. A declaration to the employer works the other way round: it is only needed when the employee wants to opt out of the relief, for example to use tax-deductible costs or joint settlement with a spouse.

What about a contract of mandate and a contract for specific work

A contract of mandate (umowa zlecenie) is covered by the relief just like an employment contract; a contract for specific work (umowa o dzieło) is not covered at all, regardless of the contractor's age or citizenship.

What happens after turning 26

The exemption stops on the day of the 26th birthday, not at the end of the tax year. From income earned from the birthday onward, the payer withholds an advance on general terms, calculated from that date rather than from the start of the month. Pay in the birthday month can therefore drop sharply, despite an unchanged contract and rate: this is a natural effect of the regulation, not a payroll error.

What about the foreigner's tax status

Citizenship does not change the rules of the relief itself, but it affects how the whole income is settled: a resident settles all income in Poland, a non-resident only income earned in Poland. How the status is determined is described in the article on foreigner's tax residency.

What to do if the relief was not applied

Nothing is lost. Overpaid tax is only recovered in the annual tax return, not automatically. It has to be filed. The rules for filling in the PIT-11 and the annual settlement for a foreigner are described in a separate article on PIT and annual settlement for a foreigner.

How the relief affects net pay

The exemption applies to income tax, not to ZUS contributions. Contributions depend on the contract type and the employee's situation, so net pay usually does not equal the gross amount. The full breakdown of deductions between gross and the transferred amount is shown in the article on calculating net and gross wages.

Frequently asked questions

### Does youth PIT relief apply to a contract of mandate with a foreign student?
Yes, on the same terms as with an employment contract, up to the PLN 85,528 annual limit, automatically, without a declaration. Citizenship and the country of the university do not matter for the relief itself.

### Does a tax non-resident also benefit from youth PIT relief?
The relief itself depends on age and contract type. If the employee is not a Polish tax resident, the way tax is calculated on their wages is determined separately; the tax office confirms this in individual cases.

### What to do if the relief was not applied despite meeting the conditions?
First report it to the coordinator, we will check the settlement. Overpaid tax can also be recovered in the annual PIT return.

### After exceeding the PLN 85,528 limit, does tax need to be paid in the annual settlement?
With one employer, the advance on the surplus over the limit is withheld on an ongoing basis, in subsequent payments. If you worked for several employers during the year, each one calculates the limit only from its own payments; then an additional payment in the annual return is possible.

### What happens to the relief when I turn 26 mid-month?
The exemption stops on the day of the birthday, not at the end of the month. The payer calculates the advance on general terms from the income earned from that date, so pay in the birthday month can drop sharply despite the same contract and rate.

This text describes the general rules. What you are entitled to depends on your type of contract: an employment contract (umowa o pracę) or a contract of mandate (umowa zlecenie). Your own contract and payslip are what count.
